Please read these Terms of Service carefully before using the www.shootshare.co website operated by ShootShare GmbH. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access the Service. In addition, when using these particular services, you shall be subject to any posted guidelines or rules applicable to such services. Any participation in this service will constitute acceptance of this agreement. If you do not agree to abide by the above, please do not use this service.

The ShootShare Platform offers an online venue that enables users (“Members”) to book, search and produce photoshoots and similar services. Members who search for, book, or use services are “Brands” and Members who receive bookings offer services are “Creatives”. Brands can generate a variety of “Deals” and “Brand Services” using the services and tools of ShootShare.

You must register an account to access and use many features of the ShootShare Platform, and must keep your account information accurate. As the provider of the ShootShare Platform, ShootShare does not own “Deals” generated by Brands. ShootShare is not a party to the contracts concluded directly between Brands and Creatives. ShootShare is not acting as an agent in any capacity for any Creative, except as specified in the Payment Terms of Service sent to you via Email before purchase. By registering an account, the user authorizes ShootShare to generate an individual account for commercial use within the scope of the general terms and conditions of ShootShare.

It is free to access and use ShootShare.co, booking fees are based on the individual pricing of Deals viewable on the homepage before and after the booking and purchase of a Deal. All prices are marked clearly within the deals dashboard for brands and always are adjusted to your needs. Part of the mission of ShootShare is to establish a fair and transparent pricing structure for creatives as they are the backbone of this industry and deserve to be treated fairly by closing wage gaps. By using ShootShare you are supporting this cause. 

This Agreement is governed in accordance with the laws of the Federal Republic of Germany. 

We maintain other terms and policies that supplement these Terms like our Privacy Policy, which describes our collection and use of personal data.

1. Our Mission

Our mission is to create a fair, transparent and green industry standard and work environment for creatives and brands. Part of our mission is therefore to support Members with a wealth of services within ShootShare to enhance the transparency of the booking and production process, as well as support Members in your daily operations and shooting needs. 

While we work hard to ensure our Members have great experiences using ShootShare we do not and cannot control the conduct of Brands and Creatives. You acknowledge that ShootShare has the right, but does not have any obligation, to monitor the use of the ShootShare Platform and verify information provided by our Members. As a Member you are responsible for understanding and complying with all laws, rules and regulations and contracts with third parties that apply to Services booked and provided.

2. Member Accounts

You must register an account to access and use many features of the ShootShare Platform. Registration is only permitted for legal entities, partnerships and natural persons who are 18 years or older. You represent and warrant that you are not a person or entity barred from using the ShootShare platform under the laws of the Federal Republic of Germany, your place of residence, or any other applicable jurisdiction. You must provide accurate, current, and complete information during registration and keep your account information up-to-date. You may not register more than one account or transfer your account to someone else. You are responsible for maintaining the confidentiality and security of your account credentials and may not disclose your credentials to any third party. You are responsible and liable for activities conducted through your account and must immediately notify ShootShare if you suspect that your credentials have been lost, stolen, or your account is otherwise compromised. If and as permitted by applicable law, we may, but have no obligation to (i) ask you to provide identification or other information, (ii) undertake checks designed to help verify your identity or background, (iii) screen you against third-party databases or other sources and request reports from service providers, and (iv) obtain reports from public records of criminal convictions or sex offender registrations or their local equivalents.

3. Fees

It is free to access and use ShootShare.co, booking fees are based on the individual pricing of Deals viewable on the homepage before and after the booking and purchase of a Deal. All prices are marked clearly within the deals dashboard for brands and always are adjusted to your needs. Part of the mission of ShootShare is to establish a fair and transparent pricing structure for creatives as they are the backbone of this industry and deserve to be treated fairly by closing wage gaps. By using ShootShare you are supporting this cause. 

ShootShare may charge fees (and applicable Taxes) to Members (Brands & Creatives) for use of the ShootShare Platform. More information about when service fees apply and how they are calculated can be found on the respective Deals Dashboard for Brands and the Creatives Dashboard within your account. Except as otherwise provided on the ShootShare Platform, service fees are non-refundable. ShootShare reserves the right to change the service fees at any time, and will provide Members notice of any fee changes before they become effective. Fee changes will not affect bookings made prior to the effective date of the fee change. If you disagree with a fee change you may terminate this agreement at any time pursuant to section 8. Termination.

4. Limitations on Liability

Neither ShootShare (including its affiliates and personnel) nor any other party involved in creating, producing, or delivering the ShootShare Platform or any Content will be liable for any incidental, special, exemplary or consequential damages, including lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, or for any damages for personal or bodily injury or emotional distress arising out of or in connection with (i) these Terms, (ii) the use of or inability to use the ShootShare Platform or any Content, (iii) any communications, interactions or meetings you may have with someone you interact or meet with through, or as a result of, your use of the ShootShare Platform, or (iv) booking of a Deal, including the provision or use of Creative Services, whether based on warranty, contract, tort (including negligence), product liability or any other legal theory, and whether or not ShootShare has been informed of the possibility of such damage, even if a limited remedy set out in these Terms is found to have failed of its essential purpose. 

Except for our obligation to transmit payments to Creatives under these Terms, in no event will ShootShare aggregate liability for any claim or dispute arising out of or in connection with these Terms, your interaction with any Members, or your use of or inability to use the ShootShare Platform, any Content, or any Creative Service, exceed: (A) to Brands, the amount you paid as a Brand during the 12-month period prior to the event giving rise to the liability, (B) to Creatives, the amount paid to you as a Creative in the 12-month period prior to the event giving rise to the liability, or (C) to anyone else, one hundred Euros (EUR100). These limitations of liability and damages are fundamental elements of the agreement between you and ShootShare. If applicable law does not allow the limitations of liability set out in these Terms, the above limitations may not apply to you.

5. Indemnification

To the maximum extent permitted by applicable law, you agree to release, defend (at ShootShare’s option), indemnify, and hold ShootShare (including ShootShare Payments, other affiliates, and their personnel) harmless from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with: (i) your breach of these Terms (including any supplemental or additional terms that apply to a product or feature) or our Policie, (ii) your improper use of the ShootShare Platform, (iii) your interaction with any Member, selection and creation of Deals, participation in our Services, including without limitation any injuries, losses or damages (whether compensatory, direct, incidental, consequential or otherwise) of any kind arising in connection with or as a result of such interaction, stay, participation or use, (iv) your failure, or our failure at your direction, to accurately report, collect or remit Taxes, or (v) your breach of any laws, regulations or third party rights such as intellectual property or privacy rights.

6. Force Majeure

ShootShare shall not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including, but not limited to, acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, pandemics, epidemics or disease, strikes or shortages of transportation facilities, fuel, energy, labor or materials. 

7. Service Guarantee

ShootShare cannot provide any guarantees regarding availability via e-mail or accessibility of the URL (http://www.shootshare.co or its other URLs) due to technical reasons. ShootShare also does not provide any guarantee for the correctness and completeness of the data transmitted online. The users use the Internet at their own risk and in doing so are subject to the applicable national or international laws and regulations. Delays of service due to force majeure or due to events for which ShootShare is not responsible and that make provision of the service difficult or impossible for longer periods (in particular, these include strikes, lockouts, official orders, etc., also if these are encountered by a subcontractor) are not the responsibility of ShootShare. These events authorize ShootShare to delay the provision of services for the duration of the problem in addition to a reasonable lead time.

8. Termination

You may terminate this agreement at any time by sending us an email or by deleting your account. If you breach the Terms we may terminate or suspend access to our Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation. All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

8.1. Member Violations

If Members breach these Terms or our Policy, you violate applicable laws, regulations or third party rights, or ShootShare otherwise becomes aware of or has received complaints about your performance or conduct, you have repeatedly cancelled confirmed bookings or failed to respond to booking requests without a valid reason, or such action is necessary to protect the personal safety or property of ShootShare, its Members, or third parties, ShootShare may: 

  • suspend or limit your access to or use of the ShootSharePlatform and/or your account;

  • suspend or remove Content;

  • cancel pending or confirmed bookings; or

  • suspend or revoke any special status associated with your account.

9. Links To Other Websites

Our Service may contain links to third-party web sites or services that are not owned or controlled by ShootShare. ShootShare has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that ShootShare shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services. Therefore, we strongly advise you to read the entire terms and conditions and privacy policy of any site that you visit as a result of following a link that is posted on our site. 

10. Intellectual Property

The Site and all of its original content are the sole property of ShootShare and are, as such, fully protected by the appropriate international copyright and other intellectual property rights laws.

11. Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days’ notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion. Your decision to continue to visit and make use of the Site after such changes have been made constitutes your formal acceptance of the new Terms of Service.
